How a Driver Can Legally Pass a Cyclist

It is extremely important to give cyclists enough space for potential changes in their path. Drivers of vehicles must pass a cyclist on the cyclist’s left side. Colorado law states that a driver can pass a cyclist moving in the same direction in the same lane if they can allow oncoming vehicles “one-half of the main-traveled portion of the roadway,” and if at least three feet of separation exists between the passing vehicle and the cyclist. According to the Colorado Department of Transportation, this is a circumstance where briefly crossing a double line is permissible, as long as it is done under safe conditions.

Failing to follow this law can result in a “Class A” traffic infraction leading to points against a license and a fine of up to $100, but more importantly, failing to follow this law could pose serious and even deadly risks to cyclists.

The law firm of Bloch Ongert has been helping injured drivers and bicyclists receive the compensation they deserve for over 30 years. Call Bloch Ongert today at 303-331-1700 to speak directly to an attorney.
